Pom Lake, LLC Lake use Rules and Regulations

Pom Lake, LLC, a limited liability corporation, owns the portion of the 38 +/- acre body of water on its property herein referred to as “our lake”. Pom Lake wishes to extend an offer of use, with limitations outlined herein as "Pom Lake, LLC Lake use Rules and Regulations", to homeowners and lot owners of Blue Lake Springs Subdivision. It is our desire to work with Blue Lake Springs Homeowner’s Association members and management to extend and enforce our Rules and Regulations for the recreational advantage of all the homeowners and lot owners in regards to lake use and lake access, as well as for the continued enhancement of the natural surroundings. All extension of use stated within this agreement serves only as an offer to the homeowners of Blue Lake Springs and is not suggestive of any future obligation on the part of Pom Lake, LLC and its affiliates. These Rules and Regulations are not meant for negotiation and may, at any time, either individually or in totality, be changed or withdrawn without prior notice. It is our wish to extend some measure of use and access of our lake to the homeowners of Blue Lake Springs in order to create an amicable relationship and continued enjoyment of our natural surrounding while at the same time preserving the beauty of the lake and protecting both the habitat and environment of the lake. Pom Lake, LLC has no affiliation with Blue Lake Springs subdivision, its owners, its Homeowner's Association, nor the developer, Highland Development, LLC, Highland Development, a Mississippi General Partnership, and Neil Burckart; and as such, Pom Lake, LLC is not bound by any covenants or restrictions associated with Blue Lake Springs Subdivision. Any covenants or rules which may apply to Blue Lake Springs Subdivision do not apply to our lake or property. We sincerely hope that this offer is well received so that continued use of our lake can be enjoyed by all homeowners with specific limits as outlined in these Rules and Regulations.
Please note that our property line begins where the property line for individual lots and/or common areas shown on the subdivision plat ends. The property line, as surveyed, does not fluctuate even though water levels do, therefore the water line does not represent the property line. We will not agree to allow anyone to make any changes to the topography, move any land or water that is located on Pom Lake property, place any structure or leave anything on or attached to our property or moored on water on our property or our lake. This includes, but is not limited to docks, boats, boat lifts, floating docks, stairs, boat ramps, and any other type of permanent or temporary structure. We want the residents of Blue Lake Springs to enjoy our lake but will not authorize any changes to the area. Enjoy it, but leave it just as you found it.
Definitions
Our Lake – the 38 +/- acre single body of water owned by Pom Lake, LLC, as surveyed and conveyed. This consists of a large majority of the lake sometimes referred to as Blue Springs Lake. It does not include the property adjacent to the spillway and dam areas, and it does not include any part of the body of water which is part of any platted lot in Blue Lake Springs Subdivision, if any. In very general terms, our lake abuts Blue Lake Springs Subdivision land on its south side, the spillway and dam area on the west, the small dam area owned and managed by Mississippi Department of Transportation at the extreme north; and wooded land to the north and east, owned by Shadow Properties, LLC.
Boat – any vessel used for transport by water will be a maximum of 20 feet in length.
Lake use/lake access - use/access will be limited to boating on the water and fishing both by boat and from the bank on lots owned by either Blue Lake Springs Subdivision or individual lot owners therein. No swimming, wading, jumping or diving will be permitted. Boating will be limited to non gasoline propulsion only (if the boat has a gas motor, it may be used for loading and unloading but no gas propulsion while on the lake). Any access of our lake via land owned by Shadow Properties is strictly prohibited.
THIS OFFER FOR A LICENSE TO USE OUR LAKE IS CONDITIONED UPON PRIOR AND PROPER EXECUTION OF A RELEASE OF LIABILITY (found here), INDEMNITY AGREEMENT, ACKNOWLEDGMENT AND ACCEPTANCE OF DANGEROUS RISKS AND HAZARDS IN A FORM WHICH IS ACCEPTABLE TO POM LAKE, LLC. RESIDENCE OF BLUE LAKE SPRINGS ARE AKSED AND EXPECTED TO SIGN THE AGREEMENT IF THERE IS INTENTION TO USE THE LAKE FOR ANY OUTLINED PURPOSE. ANYONE ELSE WHO ENTERS ONTO OUR PROPERTY OR IN OR ONTO OUR LAKE AND/OR VIOLATES THESE RULES AND REGULATIONS WILL BE TRESPASSING AND MAY BE PROSECUTED. ANYONE ENTERING IN OR ONTO OUR PROPERTY OR OUR LAKE AFTER THIS OFFER AND/OR LICENSE IS WITHDRAWN OR TERMINATED WILL BE TRESPASSING AND MAY BE PROSECUTED.
In addition to the above and any additional rules which we may adopt at any time, the specific rules for the use of the lake include the following:
1. No swimming, wading, jumping or diving will be allowed in any part of our lake;
2. Any boats must be properly registered as required by the state of Mississippi and must have all required safety equipment; and anyone occupying the boat must use appropriate life preservers at all times;
3. Boats may only be launched into the water from the existing boat ramp, adjacent to the spillway area, as permitted by HOA management. It is our understanding that gate access to that area is key controlled and monitored by HOA management to restrict access to only those homeowners with unencumbered memberships and HOA privileges and we will appreciate their continued diligence in maintaining and limiting that access per HOA guidelines. Lot owners that adjoin our lake can access the water directly from their lots if slope and grade accommodates but no equipment to facilitate launching may be placed in or on the water, no trailers may be used for access from these lots, and no boats can be moored on or in the water beyond hours noted;
4. No boats will be allowed on our lake before sunrise or later than sunset or 8:00 p.m., whichever is earlier. All lake access prohibited beginning December 1st of each year and continuing through March 1st of the following year;
5. Boats allowed on the lake to be limited to those with either: a.) no motor at all, or b.) an electric motor described as a “trolling motor” that requires a battery connection but no fuel for propulsion;
6. No boats or anything else may be left in the water after the above described hours and may not be left on our property whether covered with water or not. Removal of sunken vessels will be at the owner’s expense;
7. There will be no trotline or yo-yo fishing allowed;
8. No trash or waste may be placed in the lake including, but not limited to, personal or household garbage, as well as any fertilizer, herbicide, pesticide or other chemicals which might run off from a yard into the lake;
9. Anyone using the lake must sign and return to us an agreement for Release of liability, indemnity agreement, and acknowledgment and acceptance of dangers, risks, and hazards to release, hold harmless and indemnify us before using the lake. Failure to sign and return will suspend all individual use of our lake and violators will be trespassing and will be prosecuted;
10. The 178 acre property to the north and east on the opposite side of the lake from Blue Lake Springs Subdivision, including the land mass between the lake and the pond as well as the pond on the east end of the lake, is owned by Shadow Properties, LLC. No extension of use of that land area or pond is to be considered as being included herein. No trespassing will be allowed on that property at any time;
11. No consumption of alcohol by any individual will be allowed on our lake or surrounding properties owned by Pom Lake, LLC ;
12. No music or conversation shall be conducted at a volume or of content that could be considered offensive or inconsiderate of others;
13. No lewd or offensive acts that could be deemed inappropriate or illegal will be permitted. Any act that violates federal, state or local statutes will not be tolerated and violators will be prosecuted.
14. No one under the age of 18 is allowed in or on our lake unless accompanied by a parent or legal guardian and all other requirements herein have been met.
15. Our lake is to be left in its natural state and Pom Lake, LLC offers no assurances of lake status or condition. As natural states do change, any changes in the lake that would create challenges or dangers to an individual must be anticipated and proper precautions should be taken to minimize risk and danger. Pom Lake accepts no liability for these changes.
